Section 3-107

      (a)      If a privately owned water or sewerage system is the subject of a condemnation proceeding under this article, a jury in the proceeding shall:

            (1)      Consider as a part of an award any payment, contribution, or tax paid by the respective lot owners or purchasers toward the construction of the systems; and

            (2)      If the system has been built in connection with and for the purpose of developing home sites, subdivisions, or villages by any person and the system has been offered as an inducement for the purchase of lots or land to be served by the system, deduct from the determined value of the plant or system a sum that the jury reasonably determines was added to the purchase price of the land or lots for the purpose of constructing the system.

      (b)      (1)      If the WSSC takes privately owned systems by condemnation, the WSSC shall take the systems free and clear of all debts and liens.

            (2)      The WSSC shall make a party defendant any person who has a record lien or encumbrance against the privately owned system, and the circuit court may determine the respective amounts due the defendants.

            (3)      After the payment into court or to the proper parties:

                  (i)      The WSSC may take possession of, maintain, and operate the private system; and

                  (ii)      All properties along the line of any water main or sewer of the private system shall stand in the same relation, bear the same benefit assessment, and be subject to the same regulations and penalties as though the private system had been constructed and put into operation by the WSSC under the provisions of this article.

            (4)      A building or premises actually connected in an adequate manner with the acquired private system at the time of its purchase is not required to pay the connection charge specified under § 6-101 of this article.

      (c)      If the WSSC considers that a privately owned water supply or sewerage system is unfit, in whole or in part, for incorporation with the WSSC's system, the WSSC shall disregard the existence of the system or unfit part of the system and shall extend the WSSC's system to serve the area tributary to the existing system or unfit part of the system, and all the provisions of this article relating to systems constructed by the WSSC apply to the extension.
